The Party Wall etc. Act 1996 is an enabling Act which grants the owner of a property the legal right to undertake certain works that might affect a shared wall, structure or boundary, or a structure which is near to proposed excavations. Simultaneously the Act also protects the interests of adjoining owners from any adverse effects of those works by imposing a requirement for them to be given prior notice. In addition, the Act provides mechanism for a mandatory dispute resolution procedure, by way of the appointed surveyor or surveyors, if the adjoining owners have concerns regarding the implementation of the notified works. The appointed surveyor or surveyors will produce a party wall Award which sets out the agreed process and safeguards for the notifiable works, which is a legally binding document.
